1. Definitions

  • "Amber Willow," "we," "us," or "our" refers to Amber Willow residential care facility located in Hang Dong, Chiang Mai, Thailand
  • "Resident" refers to the individual receiving residential care services
  • "Family" or "Responsible Party" refers to the person(s) who have entered into a residential care agreement on behalf of the Resident
  • "Services" refers to residential care, accommodation, meals, activities, and support provided by Amber Willow
  • "Agreement" refers to the residential care contract between Amber Willow and the Responsible Party
  • "Website" refers to our online presence at ambeerwiilla.info

2. Acceptance of Terms

By using our website, contacting us for information, or entering into a residential care agreement, you accept and agree to be bound by these Terms & Conditions. If you do not agree with these terms, please do not use our services or website.

The Responsible Party must be at least 18 years of age and have legal capacity to enter into binding agreements under Thai law.

3. Service Description

Amber Willow provides residential care services for elderly individuals, including:

  • Accommodation in shared rooms or private cottages
  • Three daily meals prepared by our in-house kitchen
  • Housekeeping, laundry, and linen services
  • Access to gardens, common areas, and facilities
  • Social activities and cultural programs
  • Daily living assistance as appropriate to each residence type

Important Note: Amber Willow is a residential care facility, not a medical or nursing facility. We do not provide clinical nursing care, skilled medical treatment, or rehabilitation services. Residents requiring intensive medical care should seek appropriate healthcare facilities.

4. Admission Process

4.1 Application

Families interested in residential care should contact us to arrange a visit and consultation. We encourage prospective residents and families to tour our facility, meet staff, and ask questions before making a decision.

4.2 Assessment

We conduct an assessment to determine if our services are appropriate for the prospective resident's needs. This includes discussions about health status, mobility, dietary requirements, and personal preferences.

4.3 Trial Period

We may offer a trial period to help residents and families determine if Amber Willow is a good fit. Details of any trial arrangement will be specified in the residential care agreement.

5. Residential Care Agreement

Upon acceptance, the Responsible Party will enter into a written residential care agreement specifying:

  • Type of accommodation and services included
  • Monthly fee and payment terms
  • Start date and minimum commitment period (typically three months)
  • Termination notice requirements
  • Additional services available at extra cost
  • Rights and responsibilities of all parties

6. Payment Terms

6.1 Monthly Fees

Monthly fees are payable in advance by the first day of each month. Accepted payment methods include bank transfer and cash. All fees are stated in Thai Baht (฿).

6.2 Initial Deposit

A refundable security deposit equivalent to one month's fee is required before move-in. This will be returned within 30 days after the resident's departure, less any outstanding charges or damages.

6.3 Late Payment

Late payment may result in suspension of optional services until the account is current. Continued non-payment may lead to termination of the agreement.

6.4 Fee Adjustments

We reserve the right to adjust fees annually with 60 days written notice to account for increased operating costs.

7. Resident Responsibilities

Residents and their families agree to:

  • Treat staff, other residents, and visitors with respect and courtesy
  • Follow facility rules regarding safety, quiet hours, and shared spaces
  • Provide accurate health information and notify us of any changes in medical condition
  • Maintain appropriate health insurance coverage
  • Respect the property and belongings of others
  • Inform us of planned absences or visitors
  • Keep emergency contact information current

8. Our Responsibilities

Amber Willow commits to:

  • Provide services as described in the residential care agreement
  • Maintain a safe, clean, and comfortable living environment
  • Treat all residents with dignity and respect
  • Protect resident privacy and confidentiality
  • Communicate regularly with families about resident wellbeing
  • Maintain appropriate staff training and supervision
  • Respond promptly to concerns and feedback

9. Health and Medical Care

Amber Willow is not a medical facility. Residents are responsible for their own healthcare arrangements, including:

  • Maintaining relationships with personal physicians
  • Attending medical appointments
  • Covering costs of medical care, medications, and treatments
  • Making decisions about medical interventions

We will assist with medication reminders and coordination of appointments as part of our daily support, but we do not administer medications or provide medical treatment.

10. Emergency Procedures

In case of medical emergency, we will:

  • Contact emergency services immediately
  • Notify the resident's emergency contacts
  • Accompany the resident to the hospital if appropriate
  • Provide relevant health information to medical personnel

Families are responsible for all emergency medical costs and transportation.

11. Personal Belongings

Residents may bring personal items to make their space comfortable. We recommend labeling belongings and avoiding bringing valuables. Amber Willow is not responsible for loss or damage to personal property.

12. Termination

12.1 By Resident/Family

The Responsible Party may terminate the agreement with 30 days written notice. The security deposit will be returned after deducting any outstanding fees or charges.

12.2 By Amber Willow

We may terminate the agreement with 30 days notice if:

  • The resident's care needs exceed our non-medical residential care capabilities
  • There is persistent non-payment despite reasonable attempts to resolve
  • The resident's behavior poses safety risks to themselves or others
  • There is a fundamental breach of this agreement

13. Limitation of Liability

Amber Willow provides residential care services with reasonable skill and care. However:

  • We are not liable for medical outcomes, as we do not provide medical treatment
  • We are not responsible for loss or damage to personal property
  • Our liability for any service issue is limited to a refund of fees paid for the affected period
  • We are not liable for circumstances beyond our reasonable control (force majeure)

14. Privacy and Confidentiality

We handle personal information in accordance with our Privacy Policy and Thai data protection laws. We maintain confidentiality regarding resident health and personal matters, sharing information only as authorized or required by law.

15. Complaints and Dispute Resolution

We welcome feedback and take concerns seriously. If you have a complaint:

  3. We will investigate and provide a response within 14 days
  4. If the matter cannot be resolved informally, either party may pursue mediation or legal remedies under Thai law

16. Governing Law

These Terms & Conditions are governed by the laws of Thailand. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts in Chiang Mai, Thailand.

17. Changes to Terms

We may update these Terms & Conditions periodically. Significant changes will be communicated to current residents and families with at least 30 days notice. Continued use of our services after changes indicates acceptance of updated terms.
